This Licence Agreement (“EULA”) governs your use of orph software products (the “Software”, including MONOCHORD and PLUSH) and their bundled content. By installing or using the Software you accept these terms.
orph grants you a non-exclusive, non-transferable licence to install and use the Software for music production, on devices you own, control or are provided with by your employer or client, for use by a single named user. You may keep working copies for backup. The licence covers commissioned and work-for-hire projects: you may use the Software to create music that is delivered to, and owned by, a client, employer, studio or publisher.
Music you create and produce with the Software is yours. You may release and monetise it freely, including commercially — no additional clearance from orph is required. You may also assign or transfer the rights in that music to someone else, for example to a client, a game studio, a film production, a publisher or a production-music library. This includes synchronisation with moving images, use in games and other interactive media, and buy-out or work-for-hire arrangements. The music may be registered, licensed onward and exploited by the party you transferred it to, without further permission from orph.
The bundled samples, multisamples and presets (including encrypted sample packs) are licensed for use only from within the Software, as part of finished musical works — including works you deliver to a client or employer. They are not licensed for redistribution outside the Software, and they may not be delivered as separate audio files, stems of the raw content, or sample libraries.
The Software and its content are licensed, not sold. orph and its licensors retain all rights, title and interest, including all intellectual-property rights.
Updates may be provided at orph’s discretion. This licence terminates automatically if you breach it; on termination you must stop using and remove the Software.
The Software is provided “as is” to the extent permitted by law, without warranty of uninterrupted or error-free operation. Statutory warranty and liability rules, and the limits described in our Terms of Sale, apply.
A licence is held by one named person. That person may install it on up to three machines, including machines provided by an employer or client, and may use it on client projects. If several people need to use the Software at the same time, each of them needs their own licence. A licence may be reassigned to another named person once, by writing to support@orph.audio.
All product names, trademarks and registered trademarks are the property of their respective owners and are used for descriptive purposes only. Names refer to the sonic character that inspired each sound. MONOCHORD and PLUSH are not affiliated with, endorsed by, or sponsored by any listed manufacturer.
